Registration of a Carrier – National and International Freight Transport
Who has to be registered in the Commercial Register
Everybody who is a holder of a licence to carry out the activities of road transport operator, who does not carry out business activities on the grounds of a trade licence, i.e. who is not registered in the Trade Register, or carries out business activities as a natural person (self-employed), who is an operator of national and international road freight transport has to be registered in the Commercial Register. The obligation results from Section 5 (3) of the Act on Road Transport.
One of the key conditions for obtaining a licence of freight road transport operator is registration in the Commercial Register of the Slovak Republic. It is not possible to carry on business in freight road transport without fulfilling this condition, i.e. you would not obtain the permit and transport licence without it.
Who does not have to be registered in the Commercial Register
The obligation does not refer to the following transporters:
- Delivery of goods exclusively for the purposes of local supply of citizens including local marketplaces within 50 km distance.
- Transport of seeds, feeds, agricultural machinery and crops for the purpose of their usage or processing in agricultural production, including transport of live animals from farms to slaughterhouses, feeds to feed livestock and collection of milk and dairy products from farms for processing, and retransfer of milk containers.
- Transport of animal waste for disposal in rendering plants. It does not apply in case of infectious waste to which rules on dangerous substances transport do not apply.
- Non-commercial transport of humanitarian aid to citizens in emergency situations, especially at natural disasters, industrial accidents and other similar events.
- Commercial transport for armed forces, armed security forces and civil protection of the population, if such transport is carried out based on their order to fulfil their tasks and is under their control during the whole transport time.
- Collection and removal of municipal waste and transport related to its deposition and disposal at landfills or incineration plants.
- Transport of goods by vehicles with the greatest available overall weight not exceeding 3.5 t.
Registration of a carrier in the Commercial Register is carried out in the whole territory of the Slovak Republic
